Pauly Shore is being sued for alleged ‘battery’ and ‘assault’ after a man claimed he was attacked by the star’s security at The Comedy Store in an incident that occurred in November 2022.

In documents obtained by The Blast on Thursday, Sean Kehoe and his daughter Kirra Lyn Potts filed the lawsuit and claimed that following the attack, they have both suffered from ‘severe injuries.’

On the night of November 30, the pair had been guests at the The Comedy Store in West Hollywood – which is notably owned by Shore – when security allegedly ‘violently grabbed and attacked’ Kehoe.

In the lawsuit, his daughter, Kirra, further claimed that the Encino Man actor had been aware of the security’s plan for assault and ‘encouraged’ the altercation.

She further stated in the documents that after witnessing her own father be attacked, it has resulted her in experiencing ’emotional distress.’

DailyMail.com has reached out to Pauly’s representatives for comment.

Along with battery and assault, Kehoe and Potts are also suing the comedian for ‘intentional infliction of emotional distress,’ ‘negligence,’ ‘premises liability,’ as well as ‘negligence in the hiring of unfit employees.’

The two are also seeking compensation in the form of damages over medical bills, and have also asked that their attorney fees be covered.

In the documents, the father daughter duo have also requested for ‘repayment of all damages incurred’ during the incident.

The lawsuit also does not specifically state what had caused the altercation to occur, per The Blast.

The Comedy Store was founded in 1972 by Pauly’s father, Sammy Shore, his wife Mitzi and writer Rudy de Luca. The following year, Mitzi began to run the club for its nightly operations – and passed away in 2018 at the age of 87.

The lawsuit revelation comes shortly after Pauly was cast to play Richard Simmons in an upcoming biopic of the reclusive fitness star.

However, prior to the feature film, Shore can already be seen acting as Simmons, 75, in a short film called The Court Jester, which will be screened during the Sundance Film Festival – though it is not in the official lineup.

Shore has even teased to fans that his portrayal could possibly lead him to an Oscar in 2025.

Earlier this week on Wednesday, Pauly sent a message to Simmons while talking to TMZ in the hopes of getting his blessing in terms of the biopic film.

While at the Hollywood Burbank Airport, the comedian encouraged Richard to watch the short film and asked him to ‘watch it with an open heart, don’t watch it coming into it going, “I don’t want to do this…”‘

He added, ‘Watch it with your open heart and just be vulnerable and just be, “What do you think of it?”‘

‘Based off of that, and if you feel that it’s still messed up and it doesn’t track with your integrity and your thing, then let us know. But in the meantime, we’re gonna try to move forward with this piece.’

He later added that, ‘I would love to have Richard Simmons be a part of the feature film, physically to be there with me on the set.’

‘…Ultimately we would love to have him there, but if he doesn’t want to do it then I still have to get his message. It is my mission to get his message out there to save life.’

Last year, Shore revealed his intentions to play the beloved ’80s fitness icon, known for his effervescent personality and colorful gym attire.

‘I’ve noticed all the reactions to me playing Richard Simmons in a new biopic, so I reached out to him,’ he wrote on Facebook in September.

Simmons – who has not been seen in public since 2017 – is said to not be interested in taking part of the biopic.

Shore added in his post, ‘I heard he’s living deep in Big Bear. We’ve been playing phone tag (yes, he still has a phone). I’m trying to make it happen for you guys.

‘Be optimistic. In the meantime, hit up Hulu, Amazon, Disney, HBO and all the big producers. I definitely can morph into this guy. I’ll see you at the Academy Awards 2025.

Last July, Simmons made an extremely rare public statement to celebrate his 75th birthday.

Although he didn’t share a personal message with the public and his fans, he did allow his representative to speak on his behalf.

‘This is a big milestone. I just want to see him happy, which he is,’ said his rep Tom Estey about the special occasion to ET.

It was a rare form of communication from the former fitness guru, who has largely hidden from the public eye since 2014.

He was previously spotted in 2017 when he checked out of a hospital after being treated for severe indigestion.

However, he tried to avoid being seen by nearly covering himself head-to-toe with a blanket, which then required his housekeeper to lead him to a waiting car.

Despite Simmons’ recent reclusive years, fans showed that he was still in their hearts and minds when they dropped by his home on Thursday to wish him a happy 75th birthday in person.

Although they likely did not see him in person, two people were spotted carrying birthday balloons and a sign reading ‘Happy Birthday Richard! We Love You!’

His abandonment of the spotlight shocked many friends and admirers at the time, and even generated an investigative podcast, documentaries and half-baked claims that his housekeeper was holding him hostage.

Since 2014, Simmons has only spoken to the public via a few phone interviews and rare statements from his representatives.
